ملخص البحث

 تكمن مشكلة البحث في الفجوة بين التنظير الأصولي والتطبيق الفقهي، وفهم الأصولية على استنباط وتطبيق أحكام حساسة بالنسبة للأمة والمجتمع، وينتج عن هذه المشكلات تساؤلات كالتالي: ما مفهوم المصطلحات الأصولية المتعلقة بالأدلة المختلف فيها، وما أثرها في أحكام الطلاق والنفقة والحضانة، وكيف خرَّج الأصوليون أحكام الطلاق والنفقة والحضانة على أثر هذه المصطلحات، وما الذي يترتب على هذا التخريج فقهياً للمكلفين، ويهدف هذا البحث إلى توضيح مفهوم المصطلحات الأصولية المتعلقة بالأدلة المختلف فيها، و أثرها في أحكام الطلاق والنفقة والحضانة، وبيان كيف خرَّج الأصوليون أحكام الطلاق والنفقة والحضانة على أثر هذه المصطلحات، وما الذي يترتب على هذا التخريج فقهياً للمكلفين، وقد اعتمد الباحث في دراسة هذا البحث على المنهج الوصفي التحليلي، وكانت أبرز النتائج التي توصل إليها الباحث هي: أن الاستدلال بهذه المصطلحات محل خلاف بين العلماء، إلا أنها أدلة شرعية تعتمد على أدلة أخرى من الكتاب والسّنّة، وأن لهذه المصطلحات تأثيراً كبيراً على أحكام الفقه، ومنها أحكام الطلاق والنفقة والحضانة، إلا أنها تخضع لاجتهاد العلماء وضوابط الشريعة الاسلامية، ولا يجوز أن تتعارض مع نص قطعي، وأن هذه المصطلحات تلعب دورًا هامًا وحيويًّا في تكييف أحكام الفقه الإسلامي مع الظروف الزمانية والمكانية واحتياجات الناس المختلفة ورفع الحرج عنهم، وتعتبر أداة من الأدوات المنهجية الهامة التي يعتمد عليها الفقهاء في تطبيق أحكام الفقه، وتساعد في استقرار الأحكام وعدم تغييرها بلا دليل، ولها تأثير في استنباط الأحكام الشرعية المتعلقة بأحكام الفقه، بشرط عدم مخالفتها للنصوص والمقاصد الشرعية.

The Impact of Fundamental Jurisprudential Terminology (Usuli Terminology) Related to Disputed Sources of Evidence on the Rulings of Divorce, Alimony, and Child Custody

Abstract

The research problem lies in the gap between theoretical Usuli terminology and its practical application in Fiqh (Jurisprudence). It explores how variations in interpreting Usuli terminology affect the derivation and application of sensitive legal rulings. This study addresses several key questions: What is the conceptual framework of Usuli terminology related to disputed sources of evidence? How does it impact the rulings of divorce, alimony, and custody? How did scholars apply this terminology (Takhrij) to such rulings, and what are the legal consequences for the subjects of the law (Al-Mukallafin)? The research aims to clarify these concepts, demonstrate the methodology used by Usuli scholars in deriving rulings through this terminology, and outline the resulting legal implications. To achieve these objectives, the researcher employed a descriptive-analytical approach. The study reached several significant findings, most notably:

Although the reliance on this terminology (disputed sources of evidence) is a point of contention among scholars, it remains legitimate Sharia evidence derived from the Quran and Sunnah. This terminology has a profound impact on jurisprudential rulings, specifically in family law (divorce, alimony, and custody); however, it is subject to scholarly Ijtihad (independent reasoning) and Sharia constraints, and must not contradict definitive texts (Nass Qat’i). This terminology plays a vital role in adapting Islamic legal rulings to changing circumstances of time and place and meeting human needs while lifting hardship (Raf’ al-Haraj). Furthermore, it serves as an essential methodological tool for jurists, contributing to the stability of legal rulings and ensuring they are not altered without sound evidence. It significantly influences the derivation of legal rulings provided it aligns with Sharia texts and higher objectives (Maqasid al-Sharia).
